The statutory wording
Article 74 quinquies expressly covers foreign nationals who are in Spain lawfully, as well as those who entered on the corresponding visa. The authorisation may be granted for up to three years.
Consular and in-country procedures
A non-resident planning a move applies for a consular visa valid for up to one year. An applicant lawfully present in Spain applies for a residence authorisation. The circumstances and practical filing arrangements are different.
What to examine before choosing
The lawful basis of stay, time remaining, place where documents will be obtained, social security and family bundle should be assessed together. The availability of an in-country application does not make it the best route for every applicant.
